Crystal and Mineral Safety Disclosure / Disclaimer.
The following information is provided to ensure safe handling awareness and disclosure regarding the potential hazards associated with certain crystals and minerals.-
It is the customers responsibility to read not only this disclosure but do their due diligence in understanding the items/materials being purchased.

It shall be understood, Finlay Namaste is a provider of products, the seller. The buyer is responsible for researching and safe handling beyond what is provided here.

This includes the need for buyers to take into consideration any allergies that a receiving party may have.

By purchasing or handling these items, you acknowledge that you have read and understood this disclosure and accepting the responsibility for doing further research as recommended.

Potential Hazardous Elements and Handling

Some crystals and minerals may contain elements that can be hazardous to human health and safety, including but not limited to: Asbestos, Mercury, Graphite, Arsenic, Lead, Cadmium, Chromium, Silica, Beryllium, Cobalt.

As stated in section 1.1, it is the responsibility of the buyer to know the item they are purchasing.

Due to the chemical aspect of Crystals and Minerals buyers shall not expose items to high heat sources such as heaters or open flames.

Buyers shall not expose items to chemicals such as cleaning chemicals, or sprays, and washes.
-
Buyer should research possible interactions if they are be exposed to unusual elements, but again product should not have chemicals including but not limited to cleaning supplies applied.

Safe Handling and Appearance Guidelines

Finished Products: Crystals and minerals in their polished and finished state are generally safe to handle and wear. Be sure to handle with care as crystals and minerals have different hardnesses, vulnerabilities, and variability.

Hazardous & Caution States: Most raw crystals and minerals can be hazardous and toxic if inhaled or ingested. This includes any dust or particles that may be generated during handling. Handle with caution and care. Always clean hands and/or wear personal protective equipment (PPE). If you do not know what you are handling, be sure to find out and research.

Avoid Creating Dust: Grinding, carving, or otherwise creating any powder or dust from these materials can be dangerous and should be left to professionals using adequate PPE and training. It is strongly advised against performing these activities if not a trained and professional.

Buyer is responsible for their own health. Know yourself - and speak to a health professional.

Buyer is responsible for informing Seller of any allergies that need to be addressed.

It is Finlay Namaste's standard response that we are not medical experts and cannot confirm or deny safety to allergy restrictions or any other health restrictions. Buyer needs to speak to their health care provider to address any concerns they may have before handling if concerned.

Finlay Namaste's stance on Metaphysical Properties

Metaphysical Properties in regard to Crystals and Minerals can be defined as the belief that crystals have specific energies, vibrations, and healing properties that can interact with the human energy field. These properties are said to promote balance, well-being, and spiritual growth

Metaphysical and Symbolic, Holistic, and otherwise spiritual practices and healing are not scientifically founded or supported by the FDA and as such Finlay Namaste does not advocate for their use in any kind of cure. With that being said, the owner of Finlay Namaste does use metaphysical items for personal mental health uses and may make suggestions or statements of own personal encounters. RETURNS REQUESTS
-
Finlay Namaste is a small business, crystals are delicate, and their state should be observed upon delivery. Due to those reasons Finlay Namaste only entertains requests for returns and replacements within 7 days after product is delivered.

If you are having any issues with your items, please do not hesitate to reach out, as a small business, customer service is of the utmost importance to me. I will do what I can to make things right, within' reason. All requests may be forfeited if failure to abide by Finlay Namaste’s approach on Professional Communication and Ethics Policy located in section 3, Zero Tolerance Policy.

Returns: Items can be returned for full or partial refund within 7 days of receipt with receipt and valid reason for return.

Valid reason for return: item is different, damaged, not as described.

Valid reason returns will be processed as soon as possible.

Notification and documentation including, but not limited to Photo's and/or Video must be received within' 7 days of item being received by buyer.

Upon approval for refund and/or exchange, seller will provide a pre-paid return shipping label for buyer to use/apply to packaging
-
Buyer shall take photo and/or video of the items prior to packing and post packaging. These may be requested should issues occur with the return shipment that require investigation such as, but not limited to, missing or damaged items during transit.

Buyer is responsible for the safe handling, preparation, and packaging of the item. It is presumed and acceptable to re-package with packaging received originally. If packaging has been prematurely discarded, buyer is responsible for packaging.

It is buyers responsibility to assure USPS standards for shipping including, but not limited to, covering/removing previous labels, and adhering label acceptably. Any questions regarding USPS standards can be addressed at your local USPS.

It is Buyers responsibility and decision to receive receipt of drop off from USPS. Finlay Namaste advises you should and will not be held responsible for lost return shipments. Refund cannot be processed until item is received intact.

Once item is received and inspected - Refund and/or replacement will be processed.

Non-Valid and not acceptable reasons for return includes, but is not limited to: no longer want, customer does not like how it looks in person, specimen looks like it could break in the future, no longer needed, customer does not how like it looks or feels while being worn. Please see the following for further:

Majority of items from Finlay Namaste are natural materials and will have naturally occurring cosmetic "flaws" which are not considered "flaws", but actually "features" and/or "Deviations", “Inclusions”, “Fissures”, “Incomplete Fractures”, which are a part of that specimens story/journey.

Pictures and videos are provided without request and additional photos and videos can be provided upon request.

Seller visually documents and weighs shipments throughout the shipping process. Customer receiving item, inspecting and changing mind is not an acceptable reason for return.
-
Statements of items missing are considered serious and will be investigated.
-
Mistakes on seller’s behalf will be able to be identified in visual documentation that is retained during and after the shipping process.

Documentation is held for 7 days post receipt of item.

Founded Mistakes

Seller will rectify any founded mistakes.

Unfounded Mistakes

Should it be discovered to be unfounded, seller will confirm with buyer to re-check packaging. If buyer confirms still missing, seller will advise next steps which may include, but is not limited to:

filing an investigation with USPS which may involve legal representation and law enforcement needing to respond to both buyer and seller for reporting and documentation.

It has come to Finlay Namaste's attention that there are folks falsely making these claims in hopes to receive a full or partial refund; it is for this reason, all claims will be handled seriously and any attempts to commit theft or fraud in this manner will be legally enforced.

Non-Valid or Partial Returns

Buyer will need to initiate a conversation advising the situation and the desired outcome.

ZERO TOLERANCE POLICY
At Finlay Namaste, we are committed to fostering a peaceful and positive environment for not only our customers and community, but also the business including, but not limited to its owner(s), employee(s), relative(s), or associate(s). We have a zero-tolerance policy for any form of harassment, negative communication, defamation, racism, political agendas, and in general attempts to derail the safety, security, and/or positivity of the business.This policy applies to all interactions associated with our business, including, but not limited to, in-person, online, and through social media.-
Finlay Namaste’s preferred stance to provide a single warning before disengaging, or pursuing policy enforcement; however, Finlay Namaste reserves the right to disengage, discontinue communication and enforce with policy with anyone violating this policy without warning.

Stalking refers to a pattern of behavior that is intended to intimidate or harass an individual. This includes, but is not limited to:-
Following someone in person or online

Monitoring an individual's activities without their consent

Persistent, unwanted contact via phone, email, or social media

Derogatory, Offensive, Abusive, or Violent Communication
This includes any communication that is disrespectful, inflammatory, racist, politically motivated, or otherwise determined to be hurtful and/or harmful.This includes, but is not limited to:-
Use of slurs or hate speech

Threats of violence or intimidation

Any form of verbal or written abuse

Threats and/ or Defamation Attempts
Defamation involves making false statements that harm the reputation of an individual or business. This includes, but is not limited to:-
Spreading false information about Finlay Namaste or its staff

Spreading incomplete information about Finlay Namaste or its staff

Posting defamatory reviews or comments

Engaging in campaigns to damage our reputation

Threats, including defamation, such as posting on social media, or using social media to stronghold, insult, and/or intimidate are unacceptable.

Anyone engaging or exhibiting this behavior will be immediately blocked on all social media accounts and legal action will be taken including, but not limited to:

Immediate communication from Finlay Namaste advising/reminding of this policy

Contact of Law Enforcement for Harassment, Threats of Harm, and other as relevant

Contact of Legal department for cease and desist letter and/or potential further action following.

Finlay Namaste holds the right to defend and address any allegations.

Addressing and responding could occur on any and/or multiple public forums in response to defamation attempts.

Supporting documentation which would otherwise be held strictly confidential, may be released as needed to provide whole picture.

By agreeing to terms and conditions you agree and understand that should a situation arise, these documents including, but not limited to: receipts, communication, audio messages, video recordings, text messages, e-mails, supporting photo and video, may be released.

Enforcement of Policy

Any individual found to be engaging in the aforementioned behaviors will face warned or immediate consequences. Possible actions include, but are not limited to:

Blocking the individual from our social media accounts

Restricting access to our website and online services
-
Prohibiting the individual from conducting any transactions with Finlay Namaste
-
In cases requiring legal action, we will not hesitate to pursue any and all available remedies, including contacting law enforcement and/or legal assistance if necessary.

In cases requiring protection, we will not hesitate to pursue ex-parte, temporary restraining/protection orders, and/or full orders of protection.
-
Finlay Namaste holds the right to defend business and address any attempts to hurt, harm, or defame business or their associations.
-
Addressing and responding could occur on any and/or multiple public forums in response to defamation attempts.
-
Supporting documentation which would otherwise be held strictly confidential, may be released as needed to provide whole picture.

By agreeing to terms and conditions you agree and understand that should a situation arise, these documents including, but not limited to: receipts, communication, audio messages, video recordings, text messages, e-mails, supporting photo and video, may be released.

LIVE SALES

Live sales conducted on the internet are fun and modern. Finlay Namaste terms and conditions apply to all settings with emphasis on Finlay Namaste's Zero Policy Policy.

Behavior exhibited by anyone that is unacceptable will result in individual(s) being removed from ability to continue and/or participate in the future.
-
Individuals continuing to make contact after being removed, will be warned a single time that legal protective measures may be taken. Additional violation will result in legal protective measures.

Finlay Namaste conducts live sales and is happy to hold product for customers and accommodate purchasing needs. Weekly payments are required unless you plan to pay in full within 10 days from Initial Invoice date.

Past 10 days, you will be notified of options if longer than 10 days in needed.

If you would like your live sale basket listed on the website to select a formal payment plan, there is a $10 service fee for the time and duty involved with listing. This fee is permanent and will not be canceled due to changing your mind and deciding to pay directly from the invoice. (For items already listed on the website, there are no additional fees, this only applies to products uploaded custom request.)

Finlay Namaste offers a pay in 6 option or for orders over $100, or a pay in 10 option for orders over $500. Orders over $1,000 there are additional options which can be discussed. If you are interested, please read the following information about the options:

When participating in the pay in 6 or 10 plan with Finlay Namaste, an email must be received stating you would like to commit to the pay in 6 or pay in 10 plan for your invoice and that you understand the above and the following: Finlay Namaste provides options for customers to choose to pay for their purchase over time. Payment plans are considered a commitment to purchase and the following applies:

The pay in 6 or 10 options are weekly payments towards your invoice.
-
The weekly payments are either 1/6th or 1/10th (rounded up) of your total purchase depending on your basket total and your payment plan choice.

For example: If your total is $100, your weekly payment for the next 6 weeks would be $16.67. If your total is $500, your weekly payment for the next 6 weeks would be $83.34 OR $50.00 for the next 10 weeks.

More items are welcome to be added, it just may increase your weekly payment. Your payment will always be based on basket total and not remaining balance.

You are also welcome to open new invoices and/or payment plans if that is how you would prefer to manage multiple large purchases, but there is a max limit of 3 active payment plans not to exceed $3,000 in total purchases.

If you are actively behind on a payment, you CAN NOT choose to purchase more items until you are caught up on payments.

Items CAN NOT to be removed as it is a commitment to purchase. These items are withheld for you in the anticipation that they have been purchased and as such other customers can not and will not purchase.

Payments must be received weekly. This means no later than 7 days from the time of previous or initial 1st payment payment.

All payments are considered continuous non-refundable deposits towards your overall purchase.

Failure to make a weekly payment will accrue an additional service fee of $10 per occurrence.

Failure to make an on time payment (longer than 7 days from time of 1st initial payment or last received payment) will accrue an additional $10 service charge.

After 5 missed payments OR accrual of 5 service fees, Finlay Namaste holds the right to terminate the purchase agreement and Finlay Namaste will select items equal to your payments made minus service charges, taxes, shipping, and any additional fees.

It is the buyers responsibility to maintain open and honest communication. Finlay Namaste can not mind read despite a strong desire to.

Finlay Namaste holds the right to discontinue payment plan option(s) should a buyer exhibit disgruntled and otherwise hostile, defamatory, and/or derogatory behavior.

To hold baskets, a non-refundable deposit must be retained within 24 hours of your invoice being sent to you.
